DISTANCE SALES AGREEMENT

(Prepared in accordance with the Laws of the Republic of Türkiye)

This Distance Sales Agreement ("Agreement") is executed between the parties in accordance with the Law No. 6502 on the Protection of Consumers, the Regulation on Distance Contracts, and other applicable legislation of the Republic of Türkiye.

ARTICLE 2 – BUYER INFORMATION

The Buyer is the individual who places an order on [https://okisworks.myshopify.com] and whose information is collected during the ordering process.

ARTICLE 3 – SUBJECT OF THE AGREEMENT

This Agreement sets forth the rights and obligations of the parties regarding the sale and delivery of custom-made products manufactured according to the Buyer's individual preferences and specifications via the Seller's e-commerce platform.

ARTICLE 4 – PRODUCTS COVERED BY THE AGREEMENT

All products sold by the Seller are produced upon special request, tailored to the Buyer's specific preferences. There is no inventory stock of these items.

ARTICLE 5 – GENERAL PROVISIONS

  1. The Buyer declares that they have read and accepted all the pre-contractual information and terms presented electronically before placing the order.

  2. As all products are custom-made, production time may vary between 7 to 30 business days, depending on complexity.

  3. In case of delays due to force majeure or unforeseen circumstances, the Seller will inform the Buyer.

  4. Upon delivery, the Buyer must inspect the product and, if any visible damage exists, prepare a written report with the courier and notify the Seller immediately.

ARTICLE 6 – EXCLUSION OF THE RIGHT OF WITHDRAWAL

According to Article 15 of the Regulation on Distance Contracts, the Buyer does not have the right of withdrawal for products that are manufactured in line with personal requests or clearly customized.

Legal Basis: “The right of withdrawal cannot be exercised for goods produced in accordance with the consumer’s requests or clearly customized.” (Article 15/1-ğ of the Regulation on Distance Contracts)

ARTICLE 7 – GOVERNING LAW AND JURISDICTION

In the event of any dispute arising out of or relating to the interpretation or implementation of this Agreement:

  • The applicable law shall be the laws of the Republic of Türkiye, and

  • Jurisdiction shall lie with the Courts and Enforcement Offices of Türkiye, or where applicable, the Consumer Arbitration Committees and Consumer Courts in the Buyer's place of residence, depending on statutory financial thresholds.

ARTICLE 8 – FINAL PROVISIONS

This Agreement shall be deemed accepted and binding upon the Buyer's electronic confirmation during the order process.

The Buyer hereby confirms that:

  • They have read and understood this Agreement,

  • The ordered products are custom-made and not eligible for return,

  • They unconditionally accept all terms and conditions outlined herein.
